A dividing the estate and land inheritance case arose out of a dispute between a lady in Ellis County and an heir. We lost the case in District Court and before the Appellate Brief was due by the winning lawyer, he called our office and there was a take nothing judgment entered and we got everything we had requested in the underlying suit.

A young man from Mexico was scalped and both arms were pulled off in 1978. A substantial recovery was made against the hay baler company and he has gone on to learn English, obtain his Associates Degree, become married, have a daughter, owns his house, owns another house, and is a useful, productive citizen. As a result of that case, I went on to handle 7 additional hay bailer accidents across the United States. Each one was successful and the cool thing was that after the cases were concluded, the hay bailer design was changed and the intake (nip point) was revolutionized to reduce operator access and certain injury. My young client became an U.S. Citizen in 1985.

Rape case. A rape occurred in a dirt bag hotel near Fair Park. Insurance company offered money to settle the case and I declined it. The jury ruled against us.

Apartment Complex Premise Liability
An elderly lady that fell off a walkway near her apartment. We learned that the structure as it was built and maintained was in violation of the building codes and the Americans with Disability Act (ADA). The case settled for a substantial sum. The walkway was updated to make it ADA compliantand no falls have occurred since the repairs.

This lady was a guest at a major chain restaurant in the Dallas area. She walked into the restroom which was in the midst of construction. One of the witnesses testified that it was really a construction zone. Employees knew of the dangerous condition and informed management and nothing was done to repair it. Our client tripped and fell in the dark restroom stall and suffered a broken hip. Substantial damages were paid before trial.
Fire Case in Central Texas
I worked on this case with local Counsel Jon Ker out of Hewitt, Texas. House caught on fire. Burned down. Insurance company refused to pay claiming arson and the insurance carrier was proven wrong and the case was paid before trial.

Texas Stadium Handicap Seating
We worked on a case against lawyer Steve Gardner and were able to retrofit all of the restroom facilities at Texas Stadium and add ADA compliant handicapped seating and access throughout the stadium for the 5 years before it was torn down.
Fort Worth Fire Case
Businessman’s apartment complex burned to the ground. The insurance company claimed that it would not pay any damages whatsoever as a result of fire damage to a multi-unit apartment building. The insurance company was forced to pay the amount due and did pay lawyers’ fees after litigation.

Represented a lady in a divorce case from a high dollar fellow who was a partner in a big named downtown firm. Case settled before trial.
Lasik Surgery Medical Malpractice
Woman traveled to Texas from Oklahoma to get lasik surgery so she could see better. She was blinded in one eye. The doctor and his insurance company paid all of her past and future medical, substantial damage money, including lawyer fees.
Shareholder’s Rights
Man and 3 “friends” entered into a business together that became very successful. Our client was squeezed out. After filing suit and discovery, and on the eve of trial, he made a full recovery including attorney fees.
Swimming Pool
A young man dove from a diving board into an unsafe swimming pool. He became a quadriplegic. I was unable to help him because the pool manufacturer was out of business. It was a very sad case. I received the money from the homeowner’s insurance policy and gave the entire sum of money to his parents for his benefit.
Soft Drink Bottle Cap Liability
Represented young girls who upon unscrewing aluminum cap from soda bottles had the bottle cap propel off into their eye severely damaging their eyes. Received substantial awards. This dangerous condition was repaired by the bottle company.
Product Liability
This woman set on a chair at a local department store intending to buy it for her vanity. The chair busted to the ground causing severe disc disruption and an operated back. We learned through very thorough investigation that the chair was made somewhere up in the countryside of China and no one knew exactly who the chair was made by or when it was made. But we are certain the chair had not been inspected before it came to the United States. The welds and joints did not comply with USA standards. Very substantial settlement.

Drunk Driver Wreck
Man and his wife and 6 year old son were leaving church on a Sunday evening and were rear-ended by a drunk driver going 80 mph on NW Hwy. The 6 year old son was thrown from the auto and killed. There was evidence that the driver of the vehicle had been drinking and playing golf since early in the morning on St. Patrick’s Day. Substantial settlement on the eve of trial.

Cow ran across Interstate 20 on a dark night causing a wreck. Kaufman County is a “fence livestock” county. Determined the owner of the cow. Substantial recovery.
Gross Negligence Against an Employer
Man was on the first day of his job with a construction company building Hwy. 121. Without any prior training he was placed to work near the highway. He was pushed into the roadway by a fellow worker and was run over by a vehicle and died. His wife came to see me and asked why it happened. After extensive investigation and work and depositions and expert testimony, the insurance company had their lawyer make a settlement offer, but the jury returned a verdict for a substantially larger sum. Judgment was returned and the Court of Appeals affirmed the judgment and the Supreme Court refused to consider the case. This case may be the last gross negligence award against an employer in the State that was affirmed on appeal and paid. He left a widow and two children below the age of 16 at the time of his untimely death.

Policy and procedures violated and broken, un-inspected safety harness allowed a father of three children to fall to his death.

Young man on motorcycle without any fault was run over by an untrained national grocery chain 18 wheel driver – amputated leg – settled 3 days before trial. Substantial settlement.

2002 General Manager then worked for a large national co. and was hurt on the job. There was a disability insurance policy that quit paying after 3 ½ years based on a chiropractor review of neurological reports. We were able to correct this matter for our client. She will be receiving disability benefits for the next 15 years.

Fatal Truck Wreck
A young man was driving his pretty young fiancé on US Hwy 287 west of Wichita Falls and drove under an unlighted trailer crossing the roadway at an unmarked truck stop crossover during the nighttime. Both young folks died. After this wreck and substantial settlement, the State of Texas erected long tall big lights and warning signs alerting on-coming traffic to the danger and over the road trailers began using reflectors and lights to lessen the danger to motorists.
Collision with Cow on Roadway
Lady was driving on I-30 at night. A cow ran onto the roadway causing a violent collision. The lady was hospitalized and sustained serious injuries. We tracked down the owner of the cow and recovered a substantial sum. Justice was served once again.
